I. SUBJECT
Art. 1. (1) These general terms and conditions are intended to regulate the relations between the Association “SOUTHEASTERN DIGITAL INNOVATION HUB”, UIC 206045043 and the Visitors of the website http://www.digihub.bg (hereinafter referred to as the “Site”).
(2) By accessing and loading the Site, Visitors agree to be bound by these General Terms and Conditions and all subsequent amendments thereto, and undertake to comply with them.

Art. 3. The Site provides Visitors and users with information about the activities, services and prices of the Association “SOUTHEASTERN DIGITAL INNOVATION HUB”, hereinafter referred to as “DigiHub”, as well as access to the published materials.
II. INTELLECTUAL PROPERTY
Art. 4. (1) All publications on the Site are the exclusive intellectual property of “DigiHub” and are protected under the Copyright and Related Rights Act, and may not be used in any way without the prior written consent of “DigiHub”.
(2) Any unauthorized use of materials published on the Site without the permission of “DigiHub” constitutes a violation for which the infringer bears civil, administrative-penal and criminal liability in accordance with the applicable Bulgarian legislation.
Art. 5. (1) “DigiHub” does not permit the use of the Site’s content in any way through the display of all or part of the materials published therein on another website.
(2) Linking to materials on the Site from other websites is permissible if done in accordance with good morals and commercial practice, and if the linking and the manner in which the link is presented does not create doubt as to the authorship of the Association “SOUTHEASTERN DIGITAL INNOVATION HUB” over the materials, so that Visitors are not misled.
III. USE AND REGISTRATION
Art. 6. (1) “DigiHub” is a platform accessible at https://www.digihub.bg/, through which users can familiarize themselves with the services offered by “DigiHub” and submit inquiries through the online platform created for this purpose.
(2) It is not possible to conclude contracts between Users and “DigiHub” on the website https://www.digihub.bg/.
(3) On the site, the registered user may receive information regarding the performance of the contract and make payments under the concluded contract.
(4) “DigiHub” identifies Users of the site BY IP ADDRESS.
(5) “DigiHub” has the right to collect and use information about Users on the following grounds: a/ For the purposes of performing a previously concluded contract with the User, b/ For the preparation and submission of an offer based on an inquiry submitted through the online platform of the site.
(6) The information by which a person may be identified may include first name, last name, phone number, email address, as well as any other information voluntarily provided by the person. The information also includes any other information that the User enters, uses or provides when using the Services provided by “DigiHub”.
(7) “DigiHub” exercises due care and is responsible for the protection of the User’s information that has come to its knowledge in connection with the registration or the inquiry submitted through the platform, except in cases of force majeure, accidental events or malicious acts by third parties.
(8) “DigiHub” may disclose personal data to third parties only in the cases and under the circumstances provided for by law, or with the explicit consent of the Users.
(9) The registration of the User is carried out by “DigiHub” on the basis of a previously concluded contract.
(10) The User may log into their profile by entering their username, password and clicking the “Login” button.
By clicking the virtual “Login” button, which has the force of written confirmation of the General Terms and Conditions, the User makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, declaring that they are familiar with the General Terms and Conditions and the Personal Data Protection Policies, accept them and undertake to comply with them. “DigiHub” may store in log files on its server the IP address of the User, as well as any other information necessary for their identification and reproduction of their electronic statement of acceptance of the General Terms and Conditions in the event of a legal dispute. The text of the General Terms and Conditions is available on the Internet on the “DigiHub” website in a manner that allows its storage and reproduction.
A User who does not have a contract with “DigiHub” and accordingly does not have a registered profile is obliged to provide complete and accurate information to “DigiHub” regarding their identity (for natural persons), legal status (for legal entities) and other details when submitting an inquiry through the online form on the “DigiHub” website. In the event of providing false information, “DigiHub” has the right not to respond to the submitted inquiry.
(11) The User is obliged to provide complete and accurate information to “DigiHub” regarding their identity (for natural persons), legal status (for legal entities) and other details, and to update them within 7 (seven) days of any change. In the event of providing false information, “DigiHub” has the right to immediately and without notice terminate or suspend the provision of services and the maintenance of the User’s registration.
(12) The User is obliged to exercise all due care and take the necessary measures reasonably required in order to protect their password, not to disclose their password to third parties, and to immediately notify “DigiHub” in the event of unauthorized access, as well as in the event of likelihood or suspicion thereof. The User bears responsibility and risk for the protection of their password, as well as for all actions performed by them or by a third party using their password.
IV. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS
Art. 7. (1) These General Terms and Conditions may be amended by “DigiHub” at any time, and “DigiHub” shall promptly publish the amended General Terms and Conditions on the Site.
(2) Amendments to these General Terms and Conditions shall take effect for all Visitors of the Site from the moment of their announcement by “DigiHub”.
V. LIMITATION OF LIABILITY
Art. 8. (1) “DigiHub” shall not be liable for damages and lost profits of Visitors caused by the materials published on the Site.
(2) “DigiHub” shall not be liable for damages caused by Visitors to third parties as a result of the use of the Site and the materials contained therein.
(3) The parties declare that, in the event that any clause(s) of these General Terms and Conditions prove to be invalid, this shall not entail the invalidity of the entire agreement or other parts thereof. The invalid clause shall be replaced by the mandatory provisions of the law or established practice.
VI. OTHER PROVISIONS
Art. 9. For matters not regulated by these General Terms and Conditions, related to the performance and interpretation of this agreement, the provisions of the applicable legislation of the Republic of Bulgaria shall apply.
Art. 10. These General Terms and Conditions enter into force for all Visitors of the Site as of 01.06.2018.
VII. APPLICABLE LAW
Art. 11. For all matters not regulated by these General Terms and Conditions, the provisions of the applicable legislation of the Republic of Bulgaria shall apply.
